A large literature demonstrates that dark patterns fulfill their objectives more easily when they are used on mobile applications, in particular mobile game applications. The context of use of said applications generates decision-making based on System 1 (Kahneman) and heuristics, which is fast and inexpensive in terms of cognitive costs. Beyond the visible direct consequences, these techniques contribute to the reinforcement of generalized behavioral manipulation practices which question our collective relationship to the progress of techniques and question our social contract in the digital age. This communication given by Fabien Lechevalier of Laval University and Marie Potel of Amurabi aims to provide an overview of the regulatory framework governing dark patterns, identify its shortcomings, and to propose sustainable regulatory solutions that really take into account human cognitive limits.

These deceptive tricks are known as “dark patterns”: interface design techniques that aim to trick or mislead Internet users. In this talk, guest Dr. Alex Beattie reveals the degree of the presence of dark patterns across the New Zealand Internet. He demonstrates how dark patterns cluster around online financial transactions and discusses how these tricks actively undermine user privacy. He will show how dark patterns are deployed as mechanisms to drive business revenue, facilitate customer surveillance, and reduce business operations costs. The talk will conclude with a sneak peek about his future research into the efficacy of dark patterns.

Videogames use behavioural design strategies, i.e., dark patterns, to increase engagement and drive revenue. These affect consumer behaviour, e.g., extended playtime, and subsequently health, e.g., social well-being. HCI approaches such as motivational design or personalization are central to behavioural design strategies. Some approaches, e.g., guilt tripping of users, are ethically and legally questionable. This workshop aims to explore the ethical, health, and legal implications of behavioural design strategies and integrate interdisciplinary viewpoints, co-develop a road map to address behavioural design, and collect contemporary perspectives on behavioural design.

EDHEC Augmented Law Institute

This certification course is scheduled to hold from February-June 2023.

EDHEC Augmented Law Institute has created the Digital Ethics Officer Certifying Training Program, in partnership with Govern&Law, Seraphin.legal and AFJE. The program is geared at lawyers and legal professionals, data protection officers (DPOs), and consultants and digital experts.
